Terms and conditions

Introduction

These Terms set out the rules for using the Otopraca mobile application. Otopraca is a conversational job search assistant that enables the creation of a Profile and the search for job offers matched to your Profile using artificial intelligence. The Services are in the BETA production phase, which means that some of their functionalities or solutions may not be available to Users or may not work correctly. The BETA phase does not exclude or limit the rights of the Consumer under the law, including with regard to the conformity of the digital service with the Agreement. Please read the Terms carefully before using the Application. By using the Application, you accept the Terms.

§ 1. General provisions and definitions

1.1. The Terms define the rights and obligations of the Service Provider and Users in connection with the use of the Application. The Service Provider makes the Terms available free of charge before the conclusion of the Agreement for the provision of services, in the Application interface and on the website https://otopraca.pl/en/terms-and-conditions/, in a way that allows the User to obtain, reproduce and store their content.

1.2. Use of the Application is voluntary and free of charge. The Services are provided exclusively within the Application.

1.3. Starting to use the Application is equivalent to accepting the provisions of the Terms.

1.4. The User is obliged to use the Application in a manner consistent with its purpose, applicable law, the provisions of the Terms and good customs, and with respect for the personal rights and intellectual property rights of third parties.

1.5. The Application is intended for adults seeking employment and does not allow Users to publish advertisements.

1.6. The agreement for the provision of services within the Application (“Agreement”) is concluded for an indefinite period upon registration of the Account or upon starting to use the Application. The Account is created by selecting one of the available registration/login methods through an external authentication service, such as OLX, Google or Apple ID. The User may terminate this Agreement at any time with immediate effect, in particular by deleting the Account or uninstalling the Application (when using it without an Account). The Service Provider may terminate or rescind the Agreement in the cases and on the terms described in the Terms.

1.7. When the User chooses to log in through an external service, the Application will gain access to data from the User’s profile in the external service, such as: first and last name, e-mail address and identifier.

1.8. Terms used in the Terms have the following meanings:

a) Application – the Otopraca mobile application available on the App Store and Google Play, including its functions;

The provisions concerning the Consumer also apply to a natural person concluding an Agreement directly related to their business activity, where the content of the Agreement shows that it is not of a professional nature for that person;

f) Job Offer – an advertisement for a job originating from an Offer Source and presented in the Application. It does not constitute an offer within the meaning of Article 66 of the Civil Code;

g) Profile – an individual profile created by the User, containing preferences regarding the sought job, including elements such as experience, skills and industries. The Profile is not sent to Employers as part of the Service;

h) Privacy Policy – a document describing the rules for processing personal data in the Application, available in the Application and at https://otopraca.pl/en/privacy-policy/;

§ 2. Technical requirements and operation of the Application

2.1. To use the Application in full, you need a mobile device connected to the Internet, running an original Android system version 7.0 or later, or an original iOS system version 13.0 or later. The Application should be downloaded from an official store (e.g. the App Store or Google Play) and updated to the latest version available at the time. To view Source Websites, the Application may use a built-in browser.

2.2. The Service Provider makes efforts to ensure that the Application operates continuously and correctly, but does not guarantee uninterrupted access. Interruptions may occur due to maintenance work, updates, failures or causes beyond our control. The Service Provider informs of planned interruptions in the Application, where possible, in advance.

2.3. Using the Application takes place via the Internet and involves standard risks: loss of data confidentiality in the event of unauthorised access to the device or network, exposure to malicious software, possible interruptions caused by attacks on infrastructure or network failures, and receiving unsolicited messages at the e-mail address, if provided. We recommend installing Application updates and securing your device.

§ 3. Account

3.1. Using the Application does not require creating an Account, but creating one makes it possible to keep data for future searches. The Profile and chat history are stored to the extent and for the period described in the Privacy Policy. If you use the Application as a User who is not logged in, the Service Provider does not guarantee that the Profile and chat history will be kept after reinstalling the Application or changing the device.

3.2. Some Application functions may require registration. As part of registration, the User should provide true, current and complete data. Each User may have only one Account.

3.3. The Account can be deleted in the Application, in the Settings tab. After deleting the Account or Application data, the User loses access to information provided or generated during use of the Application, without the possibility of restoring it.

3.4. The Service Provider may refuse registration or restrict access to the Application if there are justified grounds, in particular a breach of the Terms, a justified suspicion of fraud or use of the Application for purposes contrary to law. Items 10.3 and 10.6 apply accordingly to such actions.

§ 4. Scope of Services

4.1. The User can create a Profile in the Application by entering, among other things, the sought role, city, employment history, experience level, skills, industries, salary expectations, type of contract and working mode. The Profile can be edited or deleted at any time.

4.2. It is possible to create more than one Profile, e.g. for different career directions. Each Profile works independently, and the AI Assistant informs which Profile is active.

4.3. Through the chat, the User describes the kind of job they are looking for, giving e.g. the position, location, salary ranges or working mode. Before searching, the AI Assistant informs which data from the Profile and which queries it used, giving the option to correct them. The Profile and conversations with the AI Assistant are private and not visible to other Users or Employers.

4.4. The Application provides Job Offers selected by the Service Provider, published on websites that constitute Offer Sources.

4.5. Job Offers are presented as search results containing, among other things, the advertisement title, the Employer’s name or information that it is not disclosed, salary ranges (if provided in the Job Offer), location, the age of the advertisement and the Offer Source. For each Job Offer, the AI Assistant may prepare a brief explanation of the match.

4.6. The User may save Job Offers they are interested in to their list of favourites. Saved Job Offers are kept in the User’s Account.

4.7. Otopraca is not a recruitment management system (ATS). The Service Provider does not mediate in concluding an employment contract and is not a party to any agreement between the User and the Employer.

4.8. The Service Provider may develop, change or withdraw individual Application functions. We inform of material changes in accordance with § 14. A change to the digital service that is not necessary to maintain its conformity with the Agreement does not involve any costs for the User. If such a change materially and negatively affects the Consumer’s access to or use of the Application, the Consumer may terminate the Agreement free of charge within 30 days of the change or of being informed of it, whichever is later.

4.9. In some cases, the Application may enable the User to automatically complete the application form related to a given Job Offer based on information contained in the Account. The Service Provider is not liable for the accuracy and truthfulness of the data contained in the application form – the User is obliged to verify them before sending.

4.10. Use of the AI Assistant service is subject to a daily limit of:

a) For logged-in Users: 100 messages, including up to 10 messages per minute;

b) For Users who are not logged in: 20 messages, including up to 10 messages per minute;

4.11. For the purposes of the point above, a “message” means any query sent to the AI Assistant in the conversation window, as well as an explanation of how a specific Job Offer matches the User, displayed after clicking the given Job Offer.

4.12. The limits referred to in item 4.10 above are reset 24 hours after the message is sent.

§ 5. AI Assistant

5.1. The AI Assistant is a system based on artificial intelligence. Responses are generated automatically. The AI Assistant uses language models provided by external providers. These providers process data on behalf of the Service Provider under data processing agreements, in accordance with the Privacy Policy.

5.2. Responses provided by the AI Assistant are generated automatically and are based on information from Job Offers, provided by the User in the Application, and on the AI Assistant’s knowledge base.

5.3. The AI Assistant’s responses may be incomplete, incorrect, out of date or unsuitable for the User’s expectations. They are for information and support purposes only; they are not an assessment of the User’s qualifications by the Employer and do not predict the outcome of recruitment. Before applying for a Job Offer, the User should in each case review its full description on the Source Website. The Service Provider does not guarantee employment or receipt of a reply from the Employer.

5.4. The AI Assistant does not make decisions towards the User that produce legal effects or similarly significantly affect them, within the meaning of Article 22 GDPR. The decision to apply for a given Job Offer is always taken by the User.

5.5. The AI Assistant does not assess the User as a candidate, does not create rankings of candidates and does not take part in the recruitment process. Matching results, where presented, relate solely to the compatibility of the Job Offer with the Profile.

5.6. If the AI Assistant provides incorrect information, the User may report the problem in the Application (the “Report” button) or to support@otopraca.pl. The Report will be reviewed by a human.

5.7. Interactions with the AI Assistant are monitored automatically in order to detect breaches of the Terms, abuse and security threats. Conversation records are linked to the User’s Account or device. The Service Provider may access and analyse the content of conversations with the AI Assistant in order to ensure User safety, prevent abuse, and develop and improve the Application. The legal bases for this processing and the User’s rights, including the right to object, are set out in the Privacy Policy. More information on how and why the Service Provider accesses and analyses the content of conversations can be found in the Privacy Policy.

5.8. When using the AI Assistant, the User undertakes not to enter content that is unlawful, offensive or violates good customs. In particular, it is forbidden to use the AI Assistant to: ask questions about content contrary to law; engage in activities inconsistent with the purpose of the Application; deliberately overload the system; carry out any form of reverse engineering of the AI model.

5.9. The User is responsible for all data and content that they place in the Application. The User declares that they hold all necessary rights, licences or consents for content entered into the Application and that entering it does not infringe intellectual property rights or other rights of third parties.

§ 6. Offer Sources and external content

6.1. Job Offers come from various Offer Sources, including the advertising services of Grupa OLX and other publicly available sources, such as the “Career” section on Employers’ websites and the Central Job Offers Database. The Employer or the Offer Source is responsible for the content of the Job Offer.

6.2. The Service Provider uses data from external websites not belonging to the Service Provider solely for real-time searching, at the moment the User submits a query, in order to present search results. Each Job Offer contains a clear, marked hyperlink to the original advertisement in the relevant Offer Source, enabling the User to access the full content on the page from which the Job Offer was aggregated.

6.3. The information “Undisclosed employer” may appear in a Job Offer if the Employer did not provide the company name in the advertisement.

6.4. The Application displays only those elements of a Job Offer that are necessary to present it to the User, including the title, location, salary ranges, type of contract, working mode, publication date, Offer Source and a link to the Source Website. The full description and requirements of the Job Offer are available on the Source Website indicated in each Job Offer.

6.5. The Application provides, based on artificial intelligence solutions, analytical and informational tools concerning the labour market. This information is for illustrative purposes only and is based on data contained in Job Offers as well as on the Service Provider’s internal sources. It does not constitute an offer, an obligation of the Employer or a guarantee of salary.

6.6. A Job Offer is removed from the Application after its publication at the Offer Source has expired, at the request of the Offer Source, or as a result of moderation in accordance with § 10.

6.7. The Service Provider is not liable for the content of Job Offers published in the Application, to the extent that they originate from third parties. The Employer bears full responsibility for the truthfulness and currency of the information contained in the Job Offer.

6.8. The Service Provider’s role is limited to making information about a Job Offer available to the User. The further recruitment process depends on the actions of the Employer and the User and remains outside the Service Provider’s control.

6.9. The Service Provider undertakes to cease indexing any Offer Source at the justified request of the relevant operator, without prejudice to the Service Provider’s right to defend its legal position in accordance with applicable law. The request can be made by contacting the service provider by e-mail at support@otopraca.pl or by clicking the “Report” button available with each Job Offer.

§ 7. Applying for jobs

7.1. Applying for a Job Offer takes place directly on the Source Website, to which the User is redirected by clicking the “Apply” button in the Application. The Source Website may be opened in the browser.

7.2. The Service Provider does not send applications for a position on behalf of the User, nor does it transmit the Profile to the Employer as part of the application process.

7.3. On the Source Website, its own terms, privacy policy and cookie rules apply.

7.4. Data that the User provides to the Employer or the operator of the Source Website in the application form are processed by them in accordance with the privacy policy of the given website. The Employer or the operator of the Source Website acts as a separate controller of these data.

§ 8. Matching and recommendation rules

8.1. The selection and sorting of presented Job Offers is based on an analysis of the criteria for assessing how closely the User’s Profile and search match the title and description of the Job Offer. The selection and order of presentation take into account parameters such as:

a) compatibility of the Job Offer with the Profile, including the target role, skills, experience, industry, location, expected salary, type of contract and working mode;

b) queries entered by the User in the chat, including the requirements specified in the query;

c) currency of the Job Offer, including its publication date and information whether the Job Offer is still available at the Offer Source;

d) completeness of the data in the Job Offer, e.g. salary ranges or location provided;

e) the User’s previous interactions with the Application, e.g. saved Job Offers, Job Offers displayed or queries submitted.

8.2. The User can influence the results by editing the Profile, changing queries, correcting data before searching, or choosing from the available sorting criteria.

8.3. The Service Provider does not use special categories of data (Article 9 GDPR) for matching, including information about health, origin, views or beliefs. The User should not provide such information in the Profile or in the chat.

8.4. The User may also sort Job Offers by publication date (newest first). The sorting mode can be changed at any time in the Application, in the “Sort” menu.

§ 9. Rules for using the Application

9.1. By using the Application, the User undertakes to comply with the law, good customs and these Terms.

9.2. It is prohibited to use the Application to:

a) publish, send or store content that is unlawful, offensive, defamatory, vulgar, discriminatory or violates the personal rights of third parties;

b) mislead Employers or other persons, including by presenting generated content as authentic documents or confirmed qualifications;

c) automatically collect, scrape or mass-download Job Offers, data from the Application or content of Source Websites;

d) circumvent technical safeguards, test vulnerabilities, introduce malicious instructions into the AI Assistant (prompt injection) or attempt to “break” the models (jailbreaking);

e) impersonate other persons, Employers or the Service Provider, including by creating false profiles;

f) send spam, advertisements or commercial messages;

g) use the content of Job Offers, salary data or AI Assistant Outputs for commercial purposes, including for sale, advertising or creating competing databases, without the consent of the entitled parties;

h) process third-party data without an appropriate legal basis;

i) disrupt the operation of the Application or use it in a manner that is burdensome to others.

9.3. Input Data entered in the conversation window of the Application remain the property of the User. The User grants the Service Provider a non-exclusive, non-transferable, royalty-free licence to store, process and use them to the extent necessary to provide the Service, for the period of its provision or until the data are deleted in accordance with the Privacy Policy.

9.4. It is prohibited to share the Account with other persons or to create accounts using other people’s data. The User is responsible for actions performed using their Account.

9.5. The Service Provider reserves the right to implement, at any time, technical safeguards in the AI Assistant and to restrict, suspend or block, in whole or in part, access to the AI Assistant whenever this is necessary for security reasons, compliance with law or in the event of a breach of these Terms.

§ 10. Use of the Application in accordance with its purpose

10.1. The Service Provider moderates content published in the Application in order to prevent breaches of the Terms and the law. Both automated tools, including topic filters blocking content unrelated to work or offensive, and human review in the case of reports are used.

10.2. The User is obliged to refrain from acting in bad faith, from abusing the functions of the Application, and from using it contrary to its purpose and to these Terms.

10.3. If a breach of the Terms, of security, of generally applicable laws, or the use of the Application contrary to its purpose is found, the Service Provider may: warn the User, restrict functions, remove content, suspend access or delete the Account, applying measures proportionate to the weight and manner of the breach. The Service Provider informs of each action in accordance with item 10.6.

10.4. The Service Provider may temporarily block an Account if there is a justified suspicion that, through it, actions endangering the security of the Application or of other Users occur or may occur. The Account may be deleted once the breach has been confirmed, in line with the principle of proportionality referred to in item 10.3. The Service Provider informs the User of the actions taken in accordance with item 10.6.

10.5. Any person using the Application may report to the Service Provider content found in the Application, including in Job Offers, that is unlawful or contrary to the Terms, using the “Report” function available within the Job Offer. The reporting person should, where possible, provide data enabling verification of the Report, in particular the reasons for considering the given content unlawful or contrary to the Terms and, where required by the form, their contact details. The Report is examined by the Service Provider without undue delay, and the decision is communicated to the reporting person if contact details were provided.

10.6. If the User’s Account is removed or restricted, the User will be informed of the type and scope of the action, its basis (a provision of the Terms or of law), the circumstances forming the basis of the decision, whether the decision was taken automatically, the right to appeal and the possibility of using out-of-court dispute resolution. This does not apply to information that could harm ongoing proceedings or is legally protected as confidential.

10.7. A moderation decision may be appealed. If the User disagrees with the outcome of the appeal, they may also use out-of-court dispute resolution before a certified body designated by the national digital services coordinator. Using this route does not exclude the right to go to court.

§ 11. Intellectual property

11.1. All intellectual property rights to the Application, including software, interface, trademarks (including the “Otopraca” mark), databases of an authorship nature and the Service Provider’s own content, belong to Grupa OLX or its licensors.

11.2. It is prohibited to copy, modify, decompile, distribute or otherwise use elements of the Application beyond the scope of permitted use, and also to aggregate, copy or re-share the content of the Application, including sets of Job Offers, in other websites or services without the Service Provider’s consent.

§ 12. Liability of the Service Provider

12.1. The Service is provided free of charge, with due diligence. The Service Provider does not guarantee that the Application will operate without disruption or that the AI Assistant’s responses will be free of errors.

12.2. The Service Provider is liable for damage in accordance with law, in particular for damage caused intentionally and for damage to a person. Outside the scope of the Service Provider’s liability remain the content of Job Offers and the actions of Employers, recruitment results, decisions made by the User on the basis of AI Assistant Outputs, the content of Source Websites, the consequences of applying outside the Application, interruptions caused by force majeure or by actions of third parties for which the Service Provider is not responsible, and data loss resulting from circumstances beyond the Service Provider’s control or from the User’s actions.

12.3. The provisions of this section do not exclude or limit the rights that the User is entitled to under generally applicable law.

12.4. The User is liable for damage caused to the Service Provider or to third parties as a result of a breach of the Terms or of law, on general principles.

12.5. The Service Provider is liable to the Consumer for the conformity of the digital service with the Agreement on the terms set out in Chapter 5b of the Act of 30 May 2014 on consumer rights.

§ 13. Complaints and out-of-court dispute resolution

13.1. Complaints concerning the operation of the Application may be sent by e-mail to support@otopraca.pl or submitted through the contact form in the Application. A complaint should include: first and last name or nickname, e-mail address, description of the problem and the request.

13.2. Complaints are handled within 14 days of receipt. The response will be sent to the e-mail address indicated in the complaint or, if no address is given, in another way available in the Application.

13.3. The Consumer may use out-of-court methods of dispute resolution, including before the permanent consumer arbitration court, and may also ask the regional Consumer Ombudsman for help. Detailed information on the possibility for a consumer to use out-of-court methods of handling complaints and pursuing claims, and on access to these procedures, is available at the offices and on the websites of county (municipal) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, Voivodeship Trade Inspectorates, and at the following websites of the Office of Competition and Consumer Protection (UOKiK):

http://www.uokik.gov.pl/spory_konsumenckie.php

http://polubowne.uokik.gov.pl/rejestr,5,pl.html

13.4. Persons using the Application, including persons or entities that have reported unlawful content, to whom decisions concerning the blocking or suspension of content available in the Application are addressed, have the right to choose any out-of-court dispute resolution body that has obtained certification issued by the Digital Services Coordinator.

13.5. Complaints in matters other than consumer matters are handled within 30 days of receipt.

13.6. The Consumer may withdraw from the Agreement without giving any reason within 14 days of the date on which it was concluded. To do so, it is enough to send the Service Provider a notice of withdrawal, for example to the e-mail address support@otopraca.pl, before this period expires. The Consumer may use the model withdrawal form set out in Appendix 1 to these Terms.

§ 14. Final provisions

14.1. The Service Provider may change the Terms for important reasons, in particular: the need to improve User safety; improving the operation of the Application; technical changes in the operation of the Application that require the Terms to be adjusted; preventing abuse; changing the scope or conditions of the services or withdrawing a function; introducing new functions, the use of which is voluntary; a change in generally applicable law or the issue of a ruling or decision by a public authority affecting the content of the Terms.

14.2. The User will be informed in each case of changes introduced to the Application by means of an in-Application notification, a message displayed on the home screen of the Application or, where an Account has been registered, by e-mail. Changes take effect on the date stated in the notice, not less than 15 days after the notice of the change, unless law provides otherwise. The notice contains a description of the changes and the date on which they take effect. If the User does not accept the changes, they may terminate the Agreement with immediate effect before the changes take effect, in particular by deleting the Account or the Application. Continued use of the Application after the changes take effect means acceptance of them.

14.3. Changes may take effect earlier only where this is required by law, by a ruling or decision of a public authority, or by the need to counter an unforeseen and immediate threat to the security of the Application or Users.

14.4. Minor editorial changes, correcting typos or numbering, do not require notification.

14.5. The User may stop using the Application at any time by uninstalling it and deleting the Account (if one was created) in the Application, in the Settings section.

14.6. The Service Provider may also terminate the Agreement and delete the User’s Account:

a) If the User has not logged in to the Application for at least 2 years and does not respond to notifications sent to their e-mail address about the intention to delete an inactive Account. In such a case the Service Provider may delete the Account no earlier than 30 days after sending the relevant warning.

b) In the event that the Service Provider decides to permanently close the Application and end the provision of services, the Service Provider will terminate the Agreements with all Users, with a notice period of at least 15 days counted from the day of notification, unless law requires a different period.

14.7. The Service Provider’s statement terminating the Agreement with a notice period will be sent to the User – in the case of a registered Account – to the e-mail address provided and, in the case of use of the Application by Users who are not logged in – as part of information displayed in the Application.

14.8. If any provision of the Terms proves to be invalid or ineffective, the remaining provisions remain in force.

14.9. Matters not regulated in the Terms are governed by generally applicable Polish law, in particular the Civil Code, the Act on the provision of services by electronic means, the Act on consumer rights and other statutes applicable to the services provided.

§ 15. Governing law and courts

15.1. The Terms and the relations with Users are governed by Polish law, subject to mandatory provisions of European Union law and of the law of the country of residence of the consumer that cannot be excluded by agreement.

15.2. Disputes with Users who are consumers are decided by the court competent under the rules on jurisdiction, in particular the court of the consumer’s place of residence. Disputes with Users who are not consumers are decided by the court competent for the Service Provider’s registered office.

15.3. The choice of Polish law does not deprive the consumer of protection granted to them by provisions that cannot be excluded by agreement, under the law that would be applicable in the absence of a choice of law.
